Clean
Energy Jobs and American Power Act
On September
30, 2009, Senators Boxer and Kerry introduced Senate
Bill 1733 as a companion bill to H.R. 2454, which was
passed by the House of Representatives in June 2009. The
Senate bill is similar to the House bill in that it
adopts a cap-and-trade approach to GHG management, but
is different in that it contains different GHG reduction
targets.
This bill has
been passed out of committee to be placed on the Senate
calendar for a vote.
Opponents of
the legislation are most concerned by the bill's removal
of the word "navigable." This simple change has
the potential to open the door for unprecedented
intrusion of the federal government on private property,
enabling the federal government to consider virtually
any body of water---including many waste treatment
systems, farm ponds, roadside ditches, desert washes,
streets and gutters, and even a puddle of rainwater as a
water of the United States and thus subject to federal
jurisdictions. ---TFI
